
Estate Planning Practice Area
Estate planning is the process of arranging for the management and ultimate transfer of a person's assets in the event of the person's death or mental incapacity. The purposes of estate planning are two-fold.
The first is to arrange for the disposition of a person's property upon his or her death. The goal here is to arrange for the transfer of a person's assets by reason of death according to the person's wishes, at the least possible expense and with the least possible conflict among, and emotional distress by, the beneficiaries.
The second involves lifetime family financial planning and includes such matters as income tax reduction, the making of gifts, the preservation or transfer of family business interests, a review of insurance needs, the management of assets in the event of the person's physical or mental incapacity, the making of medical decisions in the event of the person's physical or mental incapacity, and other matters not directly related to the transfer of property at death.
